Terms of Service
Your account, access, responsibilities, and rights when using Dungeon DJ.
Your agreement
Dungeon DJ is operated by Cody Peterson, an individual based in Florida, United States. Contact us through in-app Support, at support@dungeondj.app, or by mail at 9 Maplewood Ave., Clearwater, FL 33765, United States. Email support is available without an active account.
These Terms govern dungeondj.app and the Dungeon DJ service. They incorporate our Subscription and Refunds, Founder and Referral, Audio License, and Community Rules policies. Our Privacy Notice explains our information practices; agreeing to these Terms is not blanket consent to every use of personal information.
A specific entitlement promised in your offer governs that entitlement. Mandatory consumer rights take priority over a conflicting provision. We will not silently replace purchased benefits with less favorable website wording.
Eligibility and account security
Account holders, subscription purchasers, and independent guest users must be at least 18 and legally able to enter this agreement. New paid subscriptions are currently offered to United States residents. Expansion to other countries will be announced separately. An adult may play audio for a group that includes younger listeners; this does not permit minors to independently operate guest features or create accounts.
Provide accurate information, protect your credentials, and tell us about suspected unauthorized access. You are responsible for activity you authorize and reasonable security precautions, not automatically every act of an attacker beyond your control. An individual subscription belongs to one account holder; do not share credentials.
Up to three trusted devices may be registered. Adding another requires replacing an existing device. Device registration does not create separate user licenses. We may reasonably verify access and revoke compromised sessions to protect accounts. Any simultaneous-playback limit will be disclosed in the plan before purchase.
Using the service and your content
Authorized access permits use of the website and available catalog through supported controls. Software, visual artwork, logos, and marks remain the property of their owners. Our separate Audio License describes permitted audio uses. Normal buffering and accessibility tools are allowed; bypassing access controls, bulk extraction, scraping private information, security interference, and unlawful reverse engineering are not.
You retain ownership of content you submit. You grant us the limited permissions needed to host, store, reproduce, adapt technical formats, display, transmit, and share it according to the features and settings you choose, and to operate, secure, and moderate the service. You must have the necessary rights. This permission does not authorize unrelated commercial exploitation of your private content.
Deleting original content ends its active use except for limited backup, legal, security, and dispute retention and deliberate sharing. When another user adopts a shared location, they save an independent copy. Deleting the original or revoking its link does not remove previously adopted copies unless the sharing control says otherwise. The necessary service license continues for recipients' permitted use, subject to applicable privacy rights. Sharing cannot expand rights in third-party material.
We may use feedback to improve the service without paying for or crediting the idea. This does not transfer ownership of your uploaded media or authorize disclosure of private information.
Payments and service operation
Subscriptions renew automatically only as disclosed and authorized at checkout. Subscription and Refunds governs billing, cancellation, payment failures, and refunds. Promotions apply only when offered with their specific conditions. Free Beta or introductory access never authorizes paid billing without agreement.
We may repair software, adjust processing and layouts, replace or withdraw content, maintain systems, limit abusive traffic, and change features for legitimate operational, safety, licensing, or legal reasons. We provide reasonable advance notice of material changes affecting paid access when practicable and any remedy required by our policies or law. Urgent security or legal changes may occur sooner.
Catalog items and experimental features may change. Announcing a possible future feature does not guarantee a delivery date. This reservation does not negate an express purchased promise or Founder protection. We use reasonable care but do not promise uninterrupted or error-free operation; device, browser, network, and connected-equipment conditions also affect playback. Keep your own copies of original content.
Moderation and ending access
We may remove content, limit features, revoke sessions, suspend access, or terminate an account for a material breach of these Terms or Community Rules, a valid legal requirement, infringement, fraud, or a credible threat to people or service security. Serious harm can justify immediate action. For a fixable, nonurgent violation we ordinarily explain the issue and allow a reasonable opportunity to correct it.
We ordinarily provide a reason and appeal route unless doing so creates a security risk, compromises an investigation, exposes private information, or violates law. Appeal to support@dungeondj.app within 30 days, or later when law permits or circumstances justify it. We review relevant evidence and correct mistakes. Good-faith complaints, lawful negative reviews, and exercise of legal rights are not grounds for removal.
If we end paid access, future renewal stops. Permanent termination, including a permanent ban, receives the unused-prepaid-time remedy in Subscription and Refunds. Account, cancellation, support, and appropriate appeal routes remain available as needed.
Responsibility and disputes
To the extent permitted by law, we provide no warranties beyond the express commitments here and rights that cannot legally be excluded. Required standards of reasonable care and consumer remedies remain available.
Subject to the following exceptions, our total liability arising from the service is limited to the greater of US$100 or the fees you paid us in the 12 months before the event giving rise to the claim. To the extent permitted by law, we are not liable for indirect losses or business losses such as lost profits. These limitations do not apply to promised refunds or payment corrections, fraud, intentional misconduct, gross negligence, death or personal injury where exclusion is prohibited, or other liability that cannot legally be limited.
Consumers are not automatically required to pay all our legal fees or broadly indemnify us. We may pursue actual lawful remedies for intentional infringement, fraud, or other unlawful conduct, but do not impose punitive charges through subscription billing.
Contacting support to resolve a dispute is voluntary and does not prevent timely court, regulator, or payment-provider action. Florida law and applicable federal law govern, subject to mandatory protections where you reside. Florida courts with jurisdiction may hear disputes, without removing an eligible local-court or small-claims right. There is no mandatory arbitration or class-action waiver.
We notify account holders of material Terms changes at least 30 days before they take effect when practicable. Changes apply prospectively, with renewed consent where required. A reorganization or sale remains subject to existing obligations, privacy protections, and legal rights. If a provision is unenforceable, the remainder continues to the extent lawful. Accrued payments, limited evidence retention, and other obligations survive only for their proper purpose.
